1. About Fi.om and Acceptance of Terms

Welcome to Fi.om, a digital loan marketplace operated in the Sultanate of Oman. Fi.om provides an independent comparison and eligibility-matching platform that helps individuals and businesses identify financing options offered by licensed banks and financial institutions in Oman. Fi.om does not itself issue loans, hold deposits, disburse funds, or act as a lender in any capacity.

These Terms of Use ("Terms", "Agreement") constitute a legally binding agreement between you ("User", "you", "your") and Fi.om ("Fi.om", "we", "us", "our"). By accessing or using the Fi.om website at fi.om (the "Platform"), by creating an account, or by submitting any loan eligibility enquiry, you confirm that you have read, understood, and agree to be bound by these Terms in their entirety.

If you do not agree with any part of these Terms, you must immediately discontinue your use of the Platform. Continued use following any posted update constitutes your acceptance of the revised Terms.

These Terms should be read together with our Privacy Policy and Cookie Policy, which are incorporated herein by reference and form part of this Agreement.

2. Legal Framework and Regulatory Context

Fi.om operates in compliance with the applicable laws and regulations of the Sultanate of Oman, including but not limited to:

  • The Electronic Transactions Law (Royal Decree No. 69/2008) — governing the legal validity and enforceability of electronic contracts, signatures, and transactions in Oman.
  • The Personal Data Protection Law (Royal Decree No. 6/2022) — establishing data subject rights, obligations of data controllers, and protections for personal information.
  • The Consumer Protection Law (Royal Decree No. 66/2014) — providing rights and remedies for consumers engaging in commercial transactions.
  • Central Bank of Oman (CBO) Regulations — including directives and circulars governing the conduct of financial institutions and the promotion of credit products to consumers.
  • The Cyber Crimes Law (Royal Decree No. 12/2011) — addressing misuse of information systems and online conduct.
  • The Commercial Companies Law (Royal Decree No. 18/2019) — applicable to Fi.om's corporate structure and conduct.

References to applicable law in these Terms are not exhaustive. Fi.om reserves the right to update these Terms as the legal and regulatory environment evolves, including in response to guidance from the Capital Market Authority, CBO, or any competent supervisory authority.

3. Nature of the Fi.om Service

3.1 Marketplace Platform Only

Fi.om is a technology-driven loan marketplace and comparison tool. The Platform does not provide financial advice, credit services, deposit-taking, or any regulated activity as defined under Omani financial services law. All lending, credit assessment, and contract formation occur exclusively between you and the relevant licensed bank or financial institution ("Lender").

3.2 No Guarantee of Approval

A positive eligibility result on Fi.om does not constitute a guarantee, promise, or commitment of loan approval by any Lender. Lenders conduct their own independent credit assessments and apply their own internal lending criteria, which may differ from the eligibility parameters used on our Platform. Fi.om accepts no liability for any outcome arising from a Lender's final credit decision.

3.3 Indicative Rates and Terms

Any interest rates, repayment terms, loan amounts, or other financial parameters displayed on the Platform are indicative only. They are based on publicly available information or information supplied to Fi.om by Lenders and are subject to change without notice. Actual terms will be determined by the Lender upon completion of their own due diligence and application process.

3.4 Information and Marketing Service

The Platform may display promotional information, sponsored placements, or featured products from Lender partners. Such placements are clearly identified where required by applicable law. Fi.om may receive referral fees or commercial compensation from Lender partners in connection with completed referrals. This does not affect the integrity of our eligibility assessments or the accuracy of information displayed.

Fi.om is not a bank, financial institution, credit broker, or insurance intermediary. We are a technology company providing a digital comparison and referral service.

4. Eligibility and Account Registration

4.1 Age and Legal Capacity

The Platform is available only to individuals who are at least 18 years of age and legally capable of entering into binding contracts under the laws of the Sultanate of Oman. By creating an account or using the Platform, you represent and warrant that you meet these requirements.

4.2 Residency

The Platform is intended for use by individuals and businesses located in the Sultanate of Oman. Fi.om makes no representation that the Platform is appropriate or available for use in other jurisdictions. Users accessing the Platform from outside Oman do so at their own risk and are responsible for compliance with their local laws.

4.3 Account Creation

To access certain features of the Platform, you may be required to register for an account. When registering, you agree to:

  • Provide accurate, current, and complete information, including your full legal name, a valid email address, a valid Omani mobile number, and date of birth;
  • Maintain and promptly update your account information to keep it accurate and current;
  • Keep your password and account credentials strictly confidential;
  • Accept responsibility for all activity that occurs under your account;
  • Notify Fi.om immediately at support@fi.om if you suspect any unauthorised access to or use of your account.

4.4 One Account Per Person

You may maintain only one active account on the Platform. Creating multiple accounts for the purpose of circumventing eligibility restrictions, obtaining duplicate referral benefits, or any other deceptive purpose is strictly prohibited and may result in permanent suspension of all associated accounts.

4.5 Account Suspension and Termination

Fi.om reserves the right to suspend, restrict, or permanently terminate any account at our sole discretion and without prior notice where we have reasonable grounds to believe that the account holder has violated these Terms, provided false information, or engaged in any activity that is unlawful, harmful, or contrary to the interests of the Platform, its Lender partners, or other users.

5. User Obligations and Prohibited Conduct

5.1 Accurate and Honest Information

You agree to provide complete, truthful, and accurate information when using the Platform, including when submitting a loan eligibility enquiry. Providing false, misleading, or incomplete information is a material breach of these Terms and may constitute fraud under Omani law. Fi.om reserves the right to share information with Lenders and, where required, with law enforcement authorities.

5.2 Prohibited Activities

You agree not to use the Platform to:

  • Submit false, fabricated, or misleading information in any eligibility form or account registration;
  • Impersonate any person or entity, or misrepresent your affiliation with any person or entity;
  • Attempt to gain unauthorised access to the Platform, our servers, databases, or any connected systems;
  • Introduce, transmit, or distribute viruses, malware, spyware, ransomware, or any other harmful code;
  • Scrape, harvest, or systematically extract data, content, or information from the Platform without our express written consent;
  • Reverse-engineer, decompile, disassemble, or attempt to derive the source code of any software underlying the Platform;
  • Use automated tools, bots, or scripts to access or interact with the Platform;
  • Engage in any activity that places an unreasonable or disproportionate burden on our infrastructure;
  • Use the Platform for any purpose that is unlawful, fraudulent, abusive, harassing, threatening, defamatory, or otherwise objectionable;
  • Circumvent, disable, or tamper with any security features or access controls of the Platform;
  • Use the Platform for commercial solicitation or spam without Fi.om's express written authorisation;
  • Violate any applicable Omani law, regulation, or directive.

Violations of Section 5 may result in immediate account termination, referral to relevant authorities, and civil or criminal liability under the Omani Cyber Crimes Law (Royal Decree No. 12/2011) and related legislation.

6. Loan Eligibility Assessments

6.1 How Assessments Work

Fi.om's eligibility assessment tool uses information provided by you in the eligibility form — including but not limited to income details, employment status, nationality, loan purpose, and requested loan amount — to match your profile against the publicly available or partner-provided lending criteria of participating Lenders. The assessment is performed algorithmically and does not constitute a credit check or hard inquiry with any credit bureau.

6.2 Indicative Nature of Results

Eligibility results are indicative and informational only. A result showing that you "may be eligible" for a loan product does not guarantee that the relevant Lender will approve your formal loan application. Lenders exercise independent judgment and may apply additional criteria not reflected in the Fi.om tool, including credit bureau checks, salary verification, internal risk scores, and regulatory obligations.

6.3 One Submission Per Loan Type

To maintain the integrity of referrals to our Lender partners, the Platform limits each registered user to one eligibility submission and Lender referral per loan type (e.g., personal loan, home loan, business loan, car loan) per session. This restriction is designed to prevent duplicate referrals and ensure a quality experience for both users and Lenders. You may submit eligibility enquiries for different loan types freely.

6.4 No Storage of Sensitive Financial Data

Fi.om does not store your income figures, employment details, or specific loan parameters on a permanent basis beyond what is necessary for the referral process. Please refer to our Privacy Policy for full details of how we handle your data.

6.5 Business Loan Assessments

For business loan eligibility enquiries, you represent that you are an authorised officer, director, or shareholder of the business on whose behalf you are submitting the enquiry, and that the information provided regarding the business — including its commercial registration number, years of operation, annual revenue, and sector — is accurate and current to the best of your knowledge.

7. Lender Relationships and Third-Party Terms

7.1 Independent Lender Relationships

Each financial institution listed on the Platform is an independent third party. Fi.om does not act as agent, representative, or guarantor for any Lender. Any loan agreement you enter into as a result of a referral through Fi.om is solely between you and the relevant Lender and is governed by that Lender's own terms and conditions, which you should read carefully before proceeding.

7.2 Lender Responsibility

Fi.om exercises reasonable care in selecting and presenting Lender partners; however, we do not endorse any specific Lender, loan product, or financial institution. The inclusion of a Lender on the Platform does not constitute a recommendation, endorsement, or warranty of the quality, safety, suitability, or legality of that Lender's products or services.

7.3 Third-Party Websites

The Platform may contain links to or from third-party websites, including the websites of Lender partners. Fi.om is not responsible for the content, accuracy, privacy practices, or terms of any third-party website. Accessing third-party websites from the Platform is entirely at your own risk. We encourage you to review the terms and privacy policies of any third-party website you visit.

7.4 Complaints Against Lenders

If you have a complaint about a Lender's products, services, conduct, or credit decision, you should direct your complaint first to the Lender's own customer service or complaints team, and thereafter to the Central Bank of Oman (CBO) if the matter is not resolved to your satisfaction. Fi.om does not have the authority to intervene in or adjudicate on disputes between you and a Lender.

8. Intellectual Property Rights

8.1 Fi.om Ownership

All content on the Platform — including but not limited to the Fi.om name, logo, brand marks, website design, layout, graphics, text, algorithms, data compilations, eligibility tools, and underlying software — is the exclusive property of Fi.om or its licensors and is protected by applicable intellectual property laws, including copyright, trademark, and trade secret laws of the Sultanate of Oman and international conventions.

8.2 Limited Licence to Users

Subject to your compliance with these Terms, Fi.om grants you a limited, non-exclusive, non-transferable, revocable licence to access and use the Platform solely for your own personal, non-commercial purposes in connection with evaluating loan options. This licence does not include the right to:

  • Copy, reproduce, modify, translate, or create derivative works of any Platform content;
  • Distribute, publish, transmit, or publicly display any Platform content;
  • Remove or alter any copyright, trademark, or other proprietary notices;
  • Use any Platform content for commercial purposes without express written authorisation from Fi.om.

8.3 User-Generated Content

If you submit any feedback, ratings, reviews, or other content to the Platform, you grant Fi.om a worldwide, royalty-free, perpetual, irrevocable, non-exclusive licence to use, reproduce, modify, adapt, publish, and display such content in connection with operating and improving the Platform. You represent that you own or have the right to grant this licence and that your content does not violate any third-party rights.

8.4 Trade Marks

The Fi.om name, logo, and all associated trade marks and service marks are the property of Fi.om. Nothing in these Terms grants you any right to use any Fi.om trade mark without prior written consent. Unauthorised use of Fi.om trade marks may constitute trade mark infringement and unfair competition under applicable Omani law.

9. Disclaimers and Limitation of Liability

9.1 "As Is" Basis

The Platform and all content, tools, and services provided through it are offered on an "as is" and "as available" basis, without any warranty of any kind, whether express, implied, or statutory. To the fullest extent permitted by applicable Omani law, Fi.om disclaims all warranties, including without limitation any implied warranties of merchantability, fitness for a particular purpose, accuracy, completeness, non-infringement, and uninterrupted availability.

9.2 Service Availability

Fi.om does not warrant that the Platform will be continuously available, error-free, virus-free, or free from other harmful components. We may suspend or restrict access to the Platform at any time for maintenance, upgrades, security purposes, or other operational reasons. We will endeavour to provide notice of planned maintenance where reasonably practicable.

9.3 No Financial Advice

Nothing on the Platform constitutes financial, legal, tax, accounting, or investment advice. The information provided is for general informational and comparison purposes only. You should seek independent professional advice from a qualified financial adviser, lawyer, or accountant before making any financial decision.

9.4 Limitation of Liability

To the maximum extent permitted by applicable law, Fi.om, its directors, officers, employees, affiliates, agents, partners, and licensors shall not be liable for any direct, indirect, incidental, special, consequential, punitive, or exemplary damages arising from or related to:

  • Your use of or inability to use the Platform;
  • Any errors, omissions, or inaccuracies in Platform content;
  • Any Lender's credit decision, loan terms, conduct, or financial products;
  • Unauthorised access to or use of your account or data;
  • Any interruption, suspension, or termination of the Platform;
  • Any third-party content, products, or services accessible through or in connection with the Platform.

Some jurisdictions do not permit the exclusion or limitation of certain warranties or liability. In such cases, the above limitations apply to the fullest extent permitted by law. Nothing in these Terms excludes liability for fraud, wilful misconduct, or death or personal injury caused by negligence.

9.5 Maximum Aggregate Liability

In the event that Fi.om is found liable to you for any claim arising under or in connection with these Terms, our total aggregate liability shall not exceed the greater of (a) the total fees, if any, paid by you to Fi.om in the twelve months preceding the event giving rise to the claim, or (b) OMR 100 (One Hundred Omani Rials).

10. Indemnification

You agree to indemnify, defend, and hold harmless Fi.om and its directors, officers, employees, affiliates, agents, and successors from and against any and all claims, liabilities, damages, losses, costs, and expenses (including reasonable legal fees) arising out of or in connection with:

  • Your access to or use of the Platform;
  • Any information or content you submit to the Platform, including any false or misleading information;
  • Your breach of any provision of these Terms;
  • Your violation of any applicable law, regulation, or third-party right;
  • Any dispute between you and a Lender or other third party arising from a referral through the Platform.

Fi.om reserves the right to assume exclusive control of the defence of any matter for which you are obliged to indemnify us, in which case you agree to cooperate with Fi.om in the assertion of any available defences and to pay the costs thereof.

11. Privacy and Data Protection

Your privacy is important to us. The collection, use, storage, and protection of your personal information is governed by our Privacy Policy, which complies with the Personal Data Protection Law (Royal Decree No. 6/2022) and all other applicable Omani data protection legislation.

By using the Platform and creating an account, you consent to the collection and processing of your personal data as described in the Privacy Policy. Key points include:

  • We collect personal data that you voluntarily provide during registration and eligibility assessment;
  • We share relevant data with Lender partners solely for the purpose of processing your referral;
  • You have the right to access, correct, delete, and port your personal data in accordance with applicable law;
  • We implement industry-standard technical and organisational safeguards to protect your data;
  • We do not sell your personal data to third parties.

12. Dispute Resolution and Governing Law

12.1 Governing Law

These Terms, and any dispute or claim arising out of or in connection with them or their subject matter or formation (including non-contractual disputes or claims), shall be governed by and construed in accordance with the laws of the Sultanate of Oman.

12.2 Jurisdiction

You agree that the courts of the Sultanate of Oman shall have exclusive jurisdiction to settle any dispute or claim arising out of or in connection with these Terms. You irrevocably submit to the jurisdiction of those courts for such purpose.

12.3 Informal Resolution

Before initiating formal legal proceedings, we encourage you to contact us at legal@fi.om to seek an informal resolution. We will use reasonable efforts to resolve disputes amicably within 30 calendar days of receiving your written notice. This clause does not prevent either party from seeking urgent injunctive or other equitable relief from a competent court.

12.4 Consumer Dispute Resolution

If you are a consumer, you may also have the right to seek redress through the Consumer Protection Authority of the Sultanate of Oman. Fi.om will cooperate in good faith with any investigation or mediation by the Consumer Protection Authority in connection with a complaint.

13. Modification and Termination

13.1 Modifications to Terms

Fi.om reserves the right to modify, update, or replace these Terms at any time at our sole discretion. Where changes are material, we will provide reasonable advance notice via the Platform, by email to your registered address, or by posting a notice on the homepage. Changes will take effect on the date specified in the notice, or immediately upon posting if no date is specified.

Your continued use of the Platform following the effective date of any change constitutes your binding acceptance of the revised Terms. If you do not agree to the revised Terms, you must cease using the Platform immediately and may request deletion of your account by contacting support@fi.om.

13.2 Modifications to the Platform

Fi.om reserves the right to modify, discontinue, or remove any feature, functionality, or service offered through the Platform at any time without liability to you, except where such removal directly and materially harms rights you have already accrued under these Terms.

13.3 Termination by You

You may terminate your account at any time by contacting us at support@fi.om with a written request to close your account. Upon termination, your right to access the Platform will cease immediately. We will handle any personal data retained following termination in accordance with the Privacy Policy and applicable data retention obligations.

13.4 Survival

Sections 8 (Intellectual Property), 9 (Disclaimers and Limitation of Liability), 10 (Indemnification), 12 (Governing Law and Jurisdiction), and any other provision that by its nature should survive, shall survive the termination or expiry of these Terms.

14. Accessibility, Language, and General Provisions

14.1 Language

These Terms are provided in English. In the event of any conflict or inconsistency between an English version and any translated version, the English language version shall prevail to the extent permitted by applicable Omani law.

14.2 Accessibility

Fi.om is committed to making the Platform accessible to all users, including those with disabilities. If you require an accessible format of these Terms or experience any difficulty using the Platform, please contact us at support@fi.om and we will endeavour to accommodate your needs.

14.3 Entire Agreement

These Terms, together with the Privacy Policy and Cookie Policy, constitute the entire agreement between you and Fi.om with respect to your use of the Platform and supersede all prior or contemporaneous understandings, communications, and agreements, whether written or oral, relating to such subject matter.

14.4 Severability

If any provision of these Terms is held by a court of competent jurisdiction to be invalid, unlawful, or unenforceable, that provision shall be modified to the minimum extent necessary to make it valid and enforceable, and the remaining provisions of these Terms shall continue in full force and effect.

14.5 Waiver

No failure or delay by Fi.om in exercising any right, power, or privilege under these Terms shall operate as a waiver thereof. No single or partial exercise of any right, power, or privilege shall preclude any other or further exercise thereof or the exercise of any other right, power, or privilege.

14.6 Assignment

You may not assign, transfer, or sub-licence any of your rights or obligations under these Terms without Fi.om's prior written consent. Fi.om may assign these Terms (in whole or in part) in connection with a merger, acquisition, reorganisation, or sale of all or substantially all of its assets, without your consent but with notice.

14.7 Force Majeure

Fi.om shall not be liable for any failure or delay in performance under these Terms due to circumstances beyond our reasonable control, including but not limited to acts of God, natural disasters, war, civil unrest, government action, infrastructure failures, or interruptions to telecommunications or internet services.
